General Terms and Conditions

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Withdrawal period:
The period during which the consumer can exercise their right of withdrawal.

Consumer:
The natural person who is not acting in the course of a business or profession and who enters into a distance contract with the trader.

Day:
Calendar day.

Ongoing contract:
A distance contract relating to a series of products and/or services, where the delivery and/or acceptance obligations are spread over time.

Durable medium:
Any means that enables the consumer or trader to store information addressed personally to them in a way that allows future access and unchanged reproduction of the stored information.

Right of withdrawal:
The consumer’s right to withdraw from the distance contract within the withdrawal period.

Trader:
The natural or legal person who offers products and/or services to consumers via distance selling.

Distance contract:
A contract concluded within the framework of an organized system for distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract.

Means of distance communication:
Any means that can be used to conclude a contract without the consumer and trader being physically present in the same place at the same time.

General terms and conditions:
These general terms and conditions of the trader.


Article 2 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 30 days without giving any reason. During the withdrawal period, the consumer shall handle the product and packaging with due care.

If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and, if reasonably possible, in its original condition and packaging, in accordance with reasonable instructions provided by the trader.


Article 3 – Scope

These general terms and conditions apply to every offer made by the trader and to every distance contract and order concluded between the trader and the consumer.

Before the distance contract is concluded, the text of these terms shall be made available to the consumer. If this is not reasonably possible, it shall be indicated before the contract is concluded that the terms can be inspected at the trader’s premises and will be sent free of charge upon request.

If the contract is concluded electronically, the terms may be made available electronically in such a way that the consumer can store them on a durable medium. If this is not reasonably possible, it shall be indicated where the terms can be consulted electronically and that they will be sent free of charge upon request.

If specific product or service conditions also apply, the above applies accordingly. In case of conflict, the consumer may always rely on the provision most favorable to them.

If one or more provisions are invalid or void, the remaining provisions remain in force. The invalid provision shall be replaced by one that most closely reflects its original intent.

Matters not regulated in these terms shall be assessed in accordance with the spirit of these terms. Ambiguities shall be interpreted in line with that spirit.


Article 4 – The Offer

If an offer has a limited validity or is subject to conditions, this shall be explicitly stated. The offer is non-binding. The trader reserves the right to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services. The description is sufficiently detailed to allow proper assessment by the consumer.

Images are intended to provide a realistic representation. Obvious errors or mistakes are not binding.

All images and specifications are indicative. The trader cannot guarantee exact color matching with screen displays.

Each offer clearly states the rights and obligations, including:

  • any shipping costs
  • how the contract is concluded
  • whether the right of withdrawal applies
  • payment, delivery, and execution terms
  • validity period of the offer
  • additional communication costs
  • whether the contract is archived
  • possibility to check and correct data
  • available languages
  • applicable codes of conduct
  • minimum duration for ongoing contracts
  • optional: sizes, colors, materials

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions.

In case of electronic acceptance, the trader confirms receipt without delay. Until confirmation is received, the consumer may cancel the contract.

The trader shall take appropriate measures to secure electronic data and payments.

The trader may assess the consumer’s creditworthiness within legal limits. Orders may be refused or conditioned if justified.

Upon delivery, the consumer shall receive (in writing or on a durable medium):

  • complaint contact details
  • withdrawal terms or exclusions
  • warranty and service information
  • details referred to in Article 4
  • termination conditions for long-term contracts

For ongoing contracts, this applies only to the first delivery. All contracts are subject to availability.


Article 6 – Right of Withdrawal for Products

The consumer may withdraw within 30 days without giving reasons.

The period starts the day after receipt.

The product may only be used to the extent necessary for evaluation.

Returned products must include all accessories and, if possible, original packaging.

Notification must be sent within 30 days (written or email).

Return must occur within 30 days after notification. The consumer bears the burden of proof.

If not complied with, the purchase becomes binding.


Article 7 – Costs of Withdrawal

Return costs are borne by the consumer.

Payments will be refunded within 30 days after receiving the return or proof of shipment.


Article 8 – Exclusions

The right of withdrawal may not apply to:

  • custom-made products
  • clearly personalized items
  • non-returnable goods
  • perishable goods
  • price-dependent financial goods
  • newspapers and magazines
  • unsealed media/software
  • hygiene products with broken seals

Article 9 – Price

Prices are not increased during the offer period except for VAT changes.

Variable pricing may occur due to market conditions.

Price increases within three months are only allowed by law. After that, the consumer may cancel.

Printing and typographical errors reserved.


Article 10 – Compliance and Warranty

Products must comply with the contract and legal requirements.

Manufacturer warranties do not affect statutory rights.

Defects must be reported within 30 days.

Warranty excludes misuse, third-party repair, or external damage.


Article 11 – Delivery and Execution

Orders are processed with care and delivered within 30 days unless agreed otherwise.

In case of delay, the consumer may cancel free of charge.

Risk transfers upon delivery.


Article 12 – Ongoing Contracts

Termination allowed with max one month notice.

Fixed-term contracts cannot auto-renew, except subscriptions (max 3 months).

Contracts longer than one year can be terminated after one year with one month notice.


Article 13 – Payment

Payment must be made within seven working days after the withdrawal period begins.

Errors must be reported immediately.

In case of default, reasonable costs may be charged.


Article 14 – Complaints

Complaints must be submitted within 7 days after discovery.

Response within 14 days.

Valid complaints result in free repair or replacement.


Article 15 – Disputes

All agreements are governed exclusively by Dutch law, even if the consumer resides abroad.
